The appellate instance recognized as lawful and justified the decision of the court of first instance against a man found guilty of intentional harm to health of medium gravity.

El convicto, usando una razón menor - la pregunta de la víctima sobre si participará en un partido de fútbol - actuando por motivos de hooligan, golpeó al ciudadano al menos tres golpes en la cara.

As a result of the wrongful acts, the victim suffered bodily injuries, including closed traumatic brain injury, concussion, fracture of the bone of the nose with displacement, hematomas and a bruised wound. These injuries resulted in a temporary disruption of the functions of organs and systems lasting more than three weeks.

The court of first instance found the attacker guilty of intentional infliction of moderate harm to health from hooligan motives, and sentenced him to one year of imprisonment with serving in a colony-settlement. The defense of the convicted appealed against the sentence, challenging the qualification of the act as committed “out of hooligan motives”, as well as the size of the imposed punishment and the amount of compensation for moral damage.

Following consideration of the appeal, the court of second instance found no grounds for changing the sentence. The decision of the court of first instance was left unchanged, and the complaint of the convicted person was not satisfied.
