Almost a criminal story, but no crime: money written off, dinner gone, testimony diverged. The restaurant sends the customer to the delivery man, the app - back to the restaurant. Instead of hot pizza, they offer a coupon for the next try.

Who will be responsible for the failure and can you claim your euros back? The law leaves the buyer with more options than the customer support service sometimes offers.

Ping-pong to blame

Behind the “Order” button are different participants: the restaurant prepares food, the platform passes the order, the courier brings it to the door. But transportation can be organized by both the institution and the service - and the distribution of responsibility depends on this. When ordering through Lieferando, the seller of dishes is usually a restaurant, and the application serves as an intermediary. Therefore, claims to raw meat, burned pizza or someone else's lunch, first of all, address the institution. If the order is not taken there, it is important to establish who was responsible for the delivery.

A practical way out is to contact the restaurant and in support of the platform, saving correspondence. Shifting of responsibility does not cancel the rights of the client.

Take it off before you eat it!

Is there a salad instead of sushi? Is the package missing half the dishes? Don't rush out the boxes. Photograph the contents, stickers and check, save the order confirmation and support responses. In the complaint, list the facts: what was paid, what was brought, what shortcomings were found. Depending on the situation, you can request a replacement, correction of an error, reduction in price or a refund. But “I didn’t taste good” and “I got another dish delivered” are not the same thing. An unsuccessful seasoning in itself does not prove a violation, and a forgotten side dish is not always a reason to demand the entire cost of dinner. The evidence is more convincing until there is empty packaging left of the controversial dish.

Hunger vs. stopwatch

The promised half-hour turned into an hour. Can I cancel my order? In Germany, there is no universal rule “30 minutes late, money back”. The agreed time and circumstances are important. In case of a noticeable delay, experts of consumer centers advise to contact the contractor and set a reasonable additional deadline. For example, after 30-45 minutes over the promised time, you can give another 15 minutes if the lunch break ends. This is an example, not a statutory norm. If a new term is violated, under certain conditions, you can withdraw from the contract and demand a return.

The usual 14 days for refusal of online purchase to freshly prepared and perishable food, as a rule, do not apply. The right to complain about shortcomings and delay does not cancel.

You won't eat the coupon

For a disrupted dinner, the application can offer a voucher. Convenient platform: instead of a return, the client gets an excuse to spend money again. But if the law requires a cash refund, it is not necessary to accept a coupon. The requirements must be proportionate. A reduced portion of potatoes is not the same as a completely disappeared order. It is better to write without emotion: what was missing, when promised to bring and how much you demand to return.

Tipping for air

The courier did not appear, and his gratitude has already been listed. In the previous conditions, Lieferando had a reservation: prepaid tips could not be returned even if the order was canceled. On June 24, 2026, the Berlin Court of Appeal (Kammergericht) declared such a clause invalid on the claim of the Federal Association of Consumer Centers. The decision has not yet entered into force and does not in itself imply an automatic refund of past payments. Lieferando says it has ruled out the controversial condition and will automatically return prepaid tips on cancellation from March 2026. The money did not come - call in support. And the most transparent way to thank the delivery man is to give the tip in person, after receiving food.

Four signage, one plate

The diversity in the app can be deceptive. Under different names, virtual restaurant brands sometimes work - the so-called ghost kitchens, orders for which are prepared in the same kitchen.

ZDF journalists found four allegedly different burger shops linked to one real establishment. In another case, apparently identical pasta dishes under different signs differed in price by almost six euros. The model itself is legal, but inaccurate addresses and opaque food origins raise questions.

Service and delivery fees are added to the account. In some schemes, the platform fee for a restaurant reaches 30% of the order value; part of the costs can be reflected in the price tag. Therefore, it is useful to compare the cost with the offer on the website of the institution itself.

Behind the moving point on the map is a person who rides in the rain, in the heat and ice. The pursuit of speed puts a strain on workers, and schemes with subcontractors raise claims over working conditions. On September 25, 2026, the Bundesrat supported the initiative of Lower Saxony, Bremen and Saarland with a call to oblige platforms to hire deliverers directly. So far, this is an appeal to the federal government, not a ban on subcontracting. Delivery should save time, not turn into a search for responsible. Check the final price, fix errors, save messages and do not agree to a voucher if you are entitled to receive money. The client orders dinner, and the legal quest is not on the menu.
