Bryansk cheese producer recovered from the buyer more than 9.8 million rubles

The arbitration court of the Bryansk region satisfied the claim of the partnership on the faith of “Syr Starodubsky” to the company “Vladimir Standard” to recover debts for dairy products. The total amount of recovery, taking into account penalties and court costs, exceeded 9.8 million rubles.

Under the terms of the contract, the Staroduba manufacturer supplied the buyer with cheeses, butter and dry milk whey. The goods were transferred, but the customer did not pay for them in full. The claim of the supplier remained unanswered, after which the dispute was considered by the court.

The defendant admitted a debt of 9,621,595 rubles 98 kopecks, but asked to reduce the penalty. The court rejected this claim, stating that there were no grounds to consider it disproportionate to the violation. The amount of the penalty was agreed by the parties at the conclusion of the contract.

As a result, with LLC "Vladimir Standard" recovered debt, 100 thousand rubles of penalties and 97 274 rubles 30 kopecks of the cost of paying the state duty.
