Pervomaysky (Minsk) district department of the Investigative Committee established the circumstances of official negligence, which negligence entailed other grave consequences. This is reported on the website of the Investigative Committee, writes sb.by.

As the investigation established, in January this year, while cleaning the roof of the Dana Mall shopping center, a snow mass fell on a 17-year-old girl leaving the building. With injuries, the victim was immediately hospitalized.

Investigators found that the 33-year-old director of the enterprise, responsible for the safe performance of work with increased danger, improperly performed his duties.

On the day of the incident, the accused allowed a third-party advertising organization to clean the snow without obtaining an outfit. In fact, the snow was removed by four men, who were not officially employed, who did not undergo training, using shovels and a snowplow. One of them - a 53-year-old foreigner, not making sure that there was no one downstairs, threw snow from the roof, and he fell on a girl walking near the service exit.

Thus, the head did not ensure the security of the adjacent territory and the operation of equipment that excludes a threat to human life without protecting the danger zone.

As a result, the minor suffered serious bodily injuries.

The director was charged under Part 2 of Art. 428 (official negligence, which entailed other grave consequences by negligence) of the Criminal Code of the Republic of Belarus. Under the sanction of the prosecutor, a preventive measure in the form of bail was applied to him.

The criminal case was sent to the prosecutor for transfer to the court.

The investigator submitted to the organization the idea of eliminating the causes and conditions that contributed to the trauma of the girl. As a result of its consideration, the following measures were taken to develop a single mechanism for preventing such violations:

approved the procedure for monitoring the execution of documents when performing work with increased danger, conducted an audit of job descriptions of persons responsible for their organization;

ensure compliance with the Rules of labor protection, developed a list of requirements for third-party organizations;

conducted an unscheduled briefing with employees responsible for the organization and execution of works on the territory of the shopping center.

The worker who dropped snow was charged under Art. 155 (causing serious bodily harm through negligence) of the Criminal Code of the Republic of Belarus. The court found him guilty and sentenced him to 3 months.
