A few years ago, the accused was collecting mushrooms in the forest of the Logoi district and under the tree found a package in which lay a double-barreled gun IZH-12. The man was not a hunter, but still took the find to himself.
He kept the gun in the basement of his house. At the same time, the Minsk citizen knew that the weapons should be registered, but did not do so.
He once told a friend about him, who asked him to sell him a gun. The defendant agreed.
Subsequently, the police became aware of unregistered weapons. A criminal case was opened against the Minsk citizen. According to the expert, the gun is faulty, but suitable for shooting.
- The accused works as a locksmith, previously had problems with the law - the conviction was extinguished, said Daniil Tarima, deputy prosecutor of the Frunze district. He was charged with illegal sale of hunting firearms smoothbore, that is, committing a crime under Part 2 of Art. 295-1 of the Criminal Code, the sanction of which is up to two years in prison. The citizen fully admitted his guilt, sincerely repented of what he had done.
The interlocutor also noted that the suppression of illegal actions against weapons, first of all, is aimed at preventing the grave consequences that may occur with its illegal use.
- Deliberate illegal actions against firearms, ammunition and explosives can have very undesirable consequences, Tarima said. There are many cases when people, finding them, store them at home, in suburban areas or sell, transport, transfer, etc., which inevitably entails liability established by law. I would like to draw your attention to the fact that the possession of even a small number of cartridges suitable for the production of shots (and even one), already forms a crime and entails criminal liability under Art. 295 of the Criminal Code. At the same time, citizens who voluntarily surrender their illegal firearms, ammunition and explosives are exempt from criminal liability, except for cases of their sale.
