The court in Lipetsk refused “Red & White” to cancel the fine for warm wine

The Arbitration Court of the Lipetsk region refused to OOO “Beta-M”, representing the chain of stores “Red & White”, in the recognition of the illegal decision on a fine for violation of alcohol storage conditions. This was reported in the joint press service of the judicial system of the region.

The reason for the trial was the information and analytical observation conducted on November 1, 2025 in a store on Pervomaiskaya Street, 121 in Lipetsk. Then it turned out that the wine is stored in violation of the requirements of the manufacturer: the metering device recorded in the trading room +23.7 ° C, while the recommended range for this product is from +5 to +20 ° C. On this fact, an official of the Ministry of Trade and Price Policy of the Lipetsk region drew up a protocol on an administrative offense under Part 1 of Article 14.43 of the Administrative Code of the Russian Federation and imposed a fine of 100,000 rubles.

The company did not agree with the decision and appealed to the court. In the statement, the company referred to the lack of authority of the Ministry to consider such cases and violation of the procedure for initiating administrative proceedings. The Ministry of Trade and Price Policy, in turn, objected to the satisfaction of the claims, insisting on the legality of the ruling.

Having studied the materials of the case and assessed the evidence presented, the court did not find grounds for canceling the fine and denied the application.

The decision has not yet entered into legal force – it can be appealed to the Nineteenth Arbitration Court of Appeal within ten days from the date of adoption.
