The lawyer spoke about the future of Moniava after the termination of the case

The director of “House with lighthouse” Lida Moniava will remain in his post. About this Radio RBC told her lawyer Mikhail Biryukov.

“We have said from the outset that there is no crime in her actions. She is not guilty of acts that are incriminated. Finally, the investigation made the appropriate conclusions. She continues to work in the House with the Lighthouse. The house is still functioning and children are being helped. If there is no verdict and no judicial investigation, the case is dismissed, it means there is no reason for her to leave the post of director, Biryukov said.

Speaking about the removal of preventive measures, the lawyer said that this does not happen automatically - the investigator must notify the Penitentiary Service of the termination of the case. Whether the relevant notification was sent is unknown.

To date, he said, Moniava is still restricted and wears an electronic bracelet. The founder of the “House with lighthouse” is also forbidden to be on the street from 20:00 to 8:00. She can be detained only with the permission of the investigator. Women are also not allowed to use the internet or phone.

“They must be removed if the authorities supervising the execution of the sentence are reinstated by the investigator. Well, that's it. Then it's over. We'll see what the basis is. We are not likely to appeal. But for this it is necessary to talk about further actions, you need to see a resolution on the termination of the criminal case, said the lawyer.

Speaking about how much will have to wait before the lifting of restrictions, Biryukov said that “as much as the mail in Moscow.” "The investigator said, up to a week," he shared.

At the same time, according to the lawyer, he asked to send him a photo of the presentation and was ready to independently come to the Investigative Committee to receive a submission. However, the investigator “rested” and said he would send it by mail.

The case of spreading fakes about the Armed Forces of Russia (part 2 of article 207.3 of the Criminal Code) against the founder of the “House with a lighthouse” fund Lida Moniava was terminated on October 6, for lack of corpus delicti.

According to the lawyer, the investigator informed him about the termination of the case. “The ground for termination is the absence of corpus delicti and there is no other reasoning. At least the investigator didn't tell me. More detailed comments will be made when we receive the ruling, he said.

On the morning of September 2, the house of Moniava was searched, after which the founder of the House with the Lighthouse was taken for questioning to the Investigative Committee and detained. She spent time before the trial in a temporary detention facility. The hospice then told RBC that the organization continues to work, and investigative actions are not carried out in it.

The Investigative Committee reported that Moniava became a defendant in the case of spreading deliberately false information about the actions of the Russian Armed Forces against the civilian population of Ukraine. The case was initiated under the article on the dissemination of fakes about the army on the grounds of political hatred (p. “d” part 2 of article 207.3 of the criminal code). According to Biryukov’s lawyer, the charge concerned the publication in the Moniava Telegram channel, posted in February 2023. She pleaded not guilty at the interrogation.

On September 6, Moniava in the Telegram channel said that she would leave the post of director of the “House with a lighthouse” and leave its board. Because of the ban on using the Internet, the statement was published by friends of Moniava. “I am very worried that my criminal case will have a bad impact on the Lighthouse, that people will help less,” the statement said.

On the eve of the Chairman of the Board of Trustees of the children’s hospice Marina Melia told RBC that Moniava did not have time to leave the post of Director. “Lida did not have time to resign as director. We were just picking up the nomination, she said.
