How to receive a pension of a deceased spouse in 2026: the lawyer called the conditions
A widow or widower is legally entitled to survivor’s benefits, but must meet strict criteria for the deceased’s age, status and profession.

Losing a loved one is always a difficult experience. The state provides financial support for the surviving spouse. Lawyer Mikhail Salkin explained who exactly in 2026 can claim a survivor’s pension and what nuances should be taken into account when applying for it.
The main rule: marriage must be officially registered in the registry office. Civil marriage, even long-term and joint, does not give the right to such state payments.
Who can get a pension?
1. Disabled spouses. * Under this term, the law means either the presence of a prescribed disability group or the achievement of a certain age. In 2026, this threshold is 59 years for women and 64 years for men.
2. Dependent persons. The key condition: after the death of the breadwinner, the surviving spouse must effectively be left without his own source of livelihood.
3. Parents caring for children. A non-working spouse is entitled to payments if he is engaged in the upbringing of a child of a deceased under the age of 14 years. In this case, your own age or disability does not matter.
The lawyer drew attention to a special category of citizens. If a military spouse dies as a result of a military injury, his widow or widower receives a unique right: they can simultaneously receive a survivor's pension and their own old-age insurance pension. For civilians, this combination of two pensions is generally prohibited by law.
To make payments, you must contact the Social Fund of Russia with a package of documents confirming the marriage, the fact of death of the breadwinner and the status of the applicant. Do not hesitate to clarify your rights in the fund office. Sometimes legitimate financial support is much closer than it seems.
