According to the materials of the case, in May 2025, a consumer loan agreement was concluded remotely on behalf of the woman. Then the debt went to the collectors. The defendant stated that she did not conclude a contract, and in April 2024 she appealed to the police with a statement of fraud. In July 2026, a criminal case was opened on this fact.
In court, it turned out that the bank card on which the money was supposed to come does not belong to the woman. There were no funds in five banks. The phone number to which SMS codes were sent to sign the contract was also registered to another person.
The court decided that the loan agreement is considered concluded only from the moment of transfer of money. The plaintiff did not provide evidence that it was the defendant who received the funds and wanted to conclude the contract. The lawsuit was denied. The decision has not yet entered into legal force.
