Hereditary rights of children discussed with the participation of notaries of CIS countries

The expert council of the working group on the protection of property rights of minors was held on October 12, 2026 by the Office of the Presidential Commissioner for the Rights of the Child. The theme of the meeting was “Children’s Hereditary Rights: Interagency Cooperation, Digital Solutions and Practical Protection Mechanisms”. The event was held in a hybrid format: in person and in video conferencing mode. It was attended by representatives of relevant departments, lawyers, employees of guardianship bodies of the Russian Federation, notaries from CIS countries. - In 2025, the Federal Office of the Commissioner for Children’s Rights received 151 appeals on inheritance issues – against 81 a year earlier. In the regions - 749 against 511. The situations are different: legal representatives miss the deadline for accepting the inheritance, along with the property, debts pass to the child, difficulties arise with small shares in housing, renunciation of the inheritance or its division, the children’s ombudsman said.

The Chairman of the Belarusian Chamber of Notaries, Head of the basic organization of the CIS in the field of notarial activities Elena Grinkevich noted the special role of notaries in protecting the property rights of children, especially in the registration of inheritance.

- It is the notary who is often the first to face a situation when it is necessary to balance the interests of heirs, among whom there are minors. It is the notary in the process of inheritance of property that takes measures to protect the hereditary rights of children, monitors the legality of transactions, prevents possible abuses by unscrupulous adults, said Elena Grinkevich.

During the meeting, the participants discussed the mechanisms of interdepartmental cooperation aimed at ensuring and protecting the inheritance rights of minors, the regulatory regulation of digital assets in hereditary legal relations, mediative support for inheritance disputes involving minors and other issues. At the event, notarial experience in protecting the rights of minors in the Republic of Belarus, the Republic of Armenia and the Republic of Kazakhstan was presented. Presentations were made by a member of the Public Council of the Basic Organization of the CIS Member States in the field of notarial activities, a notary of the city of Yerevan, a member of the standing commission of the Notary Chamber of the Republic of Armenia on ensuring unified notarial practice and educational and methodological issues Gayane Azaryan, a notary of the city of Almaty, a candidate of legal sciences, Professor Saule Kazakeeva, a notary of the Minsk Regional Notary District Christina Shevko.
