The bailiff can take from the pensioner a living wage, leaving him without means of subsistence. To avoid this, the pensioner must submit an application to the relevant departments. This is reported by the publication “Arguments of the week”, which spoke with the lawyer Nikolai Popov.
The application must be accompanied by documents confirming the monthly income and its sources. The application is considered within ten days and makes a decision: to satisfy in whole or in part or to refuse. Illegal actions of the bailiff can be challenged in court.
Bailiffs have the right to write off money from a bank card on which a pension is received, if this is provided for by a court decision. According to the law “On enforcement proceedings”, in some cases it is allowed to withhold up to 70% of the amount. This rule applies to the recovery of alimony, compensation for damage to health, harm associated with the death of the breadwinner, or damage caused as a result of a crime.
