Penza Rospotrebnadzor seized unmarked vapes for 250 thousand

Office of Rospotrebnadzor in the Penza region for nine months of 2026 checked how to sell tobacco and nicotine-containing products. Decisions on inspections were made taking into account a risk-based approach, based on the data of the Honest Sign system.

From January to September, the inspectors conducted 37 unscheduled monitoring activities. Of these, nine were in the form of risk indicators in the field of digital labeling, and 28 in the form of control purchases, when violations were found immediately, without interaction with the seller. Violations were found in 100% of inspections.

In total, experts checked more than 5.6 thousand units of products. The marriage rate was 8.8 percent. Before the court decision, 418 units of unmarked nicotine-containing products worth more than 250 thousand rubles were withdrawn from circulation.

An illustrative case occurred during an on-site survey of one of the stores. The inspectors inspected the goods as ordinary buyers. It turned out that the bottles of liquid for POD-systems of the brand “Skala Only” does not have the code Data Matrix. And on the packaging of the electronic system “INSTABAR”, the code during the scan gave information about mass repeated sales – that is, the same code has been used more than once by other sellers. That suggests illegal trafficking.

Under the law on state control, such violations became the basis for an immediate test purchase. The problem with labeling was confirmed. The products were seized: 121 units for 83.9 thousand rubles. In addition, the seller released the goods at low prices and without a permit regime at the box office. The entrepreneur was brought to administrative responsibility under several articles of the Administrative Code of the Russian Federation. The total amount of fines amounted to 200 thousand rubles, and unmarked products were confiscated by court order.

For nine months, 57 administrative protocols were drawn up in respect of participants in turnover. Fourteen materials were sent to the court under part 4 of article 15.12 of the administrative code of the Russian Federation - there faces a fine with confiscation. For prevention, violators announced 93 warnings about the inadmissibility of violating mandatory requirements in the field of digital marking. Inspections and preventive measures are continuing with a risk-based approach.
