The Novotroitsk Interdistrict Prosecutor’s Office of the Kherson region conducted an inspection on the appeal of a local resident who faced an unreasonable refusal of the state registration body. It was established that in May 2026, the man applied to the authorized department with an application for state registration of ownership of the land plot in the Novotroitsk municipal district. As a basis, he presented a court decision to establish the fact of acceptance of the inheritance.
However, the regional Office of Rosreestr refused to register, citing the fact that the court decision cannot serve as a basis for entering ownership in the Unified State Register of Real Estate, and sent the applicant to a notary to complete the procedure for registration of the inheritance.
The prosecutor's office did not agree with this position and submitted a submission to the head of the registering body, which was considered and satisfied. After the intervention of the supervisory authority, the applicant’s rights were restored – the ownership of the land plot was entered into the USRN. In addition, the Rosreestr Department decided to change the practice of accounting and registration actions in the Kherson region on similar applications.
