There are cases when a passenger is squeezed into public transport and physically cannot approach the validator to pay for travel with a pass or bank card. But the inspectors do not care about this fact, and the controller issues a fine of several thousand rubles. How to challenge the fine, explained the lawyer.
Olga Vlasova noted the following: “If it is difficult to squeeze into the validator, this is not a reason for an automatic fine.
The question is how the controller recorded the fact of non-payment of travel. The Controller may draw up a ticket-free travel certificate if you have not paid through a validator. But, there is an important point: a fine can be issued by an authorized person of the regional body.
Without an official order, and especially in the words "you are fined" - it is illegal. In such cases, you can find out who is is issuing a fine by calling 112.
In such situations, there are several solutions. First of all, inform the controller or driver that the reason for the non-payment of the fare was interference with access to the validator. If you have the opportunity to pay in cash, another card, transport card or through a mobile application, there should be no penalty.
If the controller still insists on a fine, you have the right to see the resolution, which indicates: number, date, initials of the inspector and his position, as well as the article of the regional administrative code, information on the appeal procedure, details for payment and the amount. Let me remind you that without a legal order, penalties are a violation.
If you believe that the fine is unfair, there is always an opportunity to appeal it. Recordings from the DVR or video surveillance in the cabin of public transport are strong evidence.
It should be added that disabled persons of the first group and children under sixteen years of age are not entitled to be forcibly disembarked for lack of a ticket.”.
