The Fifth Court of Cassation of General Jurisdiction ruled in favor of the administration of Makhachkala on a dispute over a land plot of almost 10 hectares in the village of Novy Khushet. The city's land rights have been restored, the press service of the mayor's office said.
We are talking about a plot with cadastral number 05:40:000086:4562 with an area of 99,999 square meters. Its cadastral value exceeds 70 million rubles.
When considering the case, the court took into account violations committed during the registration of land. In particular, the resolution on the basis of which the site was issued did not correspond to the registration documents, and its original was absent from the authorized bodies.
In the criminal case, the examination confirmed signs of forgery of the document. The circumstances of illegal registration of land and damage to the municipality on an especially large scale were also established.
Work on the case was conducted in cooperation with the FSB office in Dagestan.
