A resident of the Tula region failed to achieve cancellation of debt in the amount of about 1.57 million rubles through bankruptcy procedure. The twentieth arbitration court of appeal upheld the decision according to which after the completion of the sale of the property, the man was not released from further performance of obligations to creditors.

Tulyak filed a declaration of bankruptcy in February 2025. At the same time, he was actively applying for new loans. From November 11, 2024 to January 3, 2025, the man concluded 26 loan agreements with banks and microfinance organizations.

At that time, he already had two outstanding loans totaling almost 1 million rubles. Monthly payments on them amounted to about 33.2 thousand rubles. The average income of a man for 2024 was about 44 thousand rubles a month.

The court also examined the information that Tulyak provided when issuing one of the new loans. In the questionnaire, he indicated a monthly income of 61,075 rubles. At the same time, the confirmed average monthly earnings for the corresponding period amounted to about 54.6 thousand rubles.

The Court of Appeal concluded that the man had consistently increased his debts by accepting new financial obligations which, taking into account his income, he could not fulfill. At the same time, he did not provide evidence of the availability of other funds to repay loans.

The property sale procedure was completed on May 25, 2026. However, according to its results, the man was not released from the requirements of creditors.

Tulyak tried to appeal the decision. He insisted that the intent to harm creditors had not been proven and that it was the responsibility of banks to check the financial position of borrowers. In addition, the man indicated that he did not hide his property.

The Court of Appeal found no grounds for quashing the earlier decision and dismissed the complaint.

Thus, after the completion of the bankruptcy procedure, a resident of the Tula region retained obligations to creditors in the amount of about 1.57 million rubles.

Earlier, “MK in Tula” reported that on September 30 in the village of Plekhanovo police and bailiffs conducted a preventive raid. Following the inspections, three citizens were sent to the military enlistment office.
