In Kursk, a man received 50 thousand compensation for falling into a pit at the Pushkinsky shopping center

It appears that the plaintiff stumbled and fell. He suffered multiple bruises, abrasions and a fractured nose bones, after which he was in the hospital for almost a month. The man asked to recover from the owner of the building of the shopping center "Pushkin" 1 million rubles compensation for moral damage, as well as the costs of treatment, examination and state duty.

The court found that at the time of the fall, the plaintiff was in a state of alcoholic intoxication - this turned out when he was admitted to the hospital. He provoked a conflict with third parties, got hit and fell. Trying to stand up, he lost stability and coordination and fell into a pit. The court regarded this as gross negligence, which contributed to the occurrence of bodily harm.

It also turned out that at the staircase entrance of the basement there were no enclosing structures - a visor, a protective net or a grille, which exclude the fall of a person. This violates the safety of the building.

Taking into account all the circumstances, the court reduced the amount of compensation and recovered in favor of the plaintiff 50 thousand rubles, as well as other expenses - examination, treatment and state duty - by 39 500 rubles.

The plaintiff disagreed with the decision and filed an appeal. The results of the consideration of the case by the Kursk Regional Court will be reported additionally.
