In Melenki, the bailiff service was obliged to pay money for six months of unpaid alimony

The prosecutor’s office of the Melenkovsk district has obtained a court decision to recover damages from the Federal bailiff service in favor of the mother of a small child. The reason is illegal inaction of the bailiff.

In the course of checking the observance of the rights of children, it was established that the bailiffs department had proceedings to recover alimony from a local resident.

In September last year, the debtor was sentenced under Part 1 of Art. 157 of the Criminal Code of the Russian Federation (non-payment of alimony) to 8 months of forced labor. While serving his sentence, he officially employed auxiliary workers in an agricultural enterprise and received wages.

However, the bailiff-executor did not make a decision on foreclosure on the debtor's income in time and did not send it to the employer. The document was issued only in April this year after the intervention of the Prosecutor’s office. As a result, from October 2025 to April 2026, the child did not receive the due payments.

The court recognized the inaction of the bailiff illegal and recovered from the service of bailiffs in favor of the mother losses in the amount of more than 60 thousand rubles. The decision has not entered into legal force.
