In Narovla, a college student spent money irrationally, in connection with which he was deprived of the right to dispose of income under 18 years. The details of the case and the mechanism of such protection of the rights and legitimate interests of adolescents explained in the Prosecutor’s office of the Gomel region, writes sb.by.
According to BelTA, the student has the status of a child left without parental care, he is on full state support. His legal representative is the director of the college where the guy is studying.
“The teenager received a monthly stipend and payments provided for by the regulation on the conditions and procedure for providing state support to orphans, children left without parental care, as well as quarterly compensation for the purchase of clothing and food,” the ministry said.
Prosecutors examined the living conditions of the teenager in the college dormitory. The inspectors drew attention to the facts of improper provision of basic necessities.
“The amount of food appropriate to the age of the minor was insufficient. He used to buy himself chips and soda. In the presence of three meals a day in the dining room of the educational institution, the guy stayed on weekends and holidays, the vacation period without food. In addition, the young man lacked seasonal clothing and personal hygiene products. The incoming money he spent irrationally, — noted in the Prosecutor’s office.
The administration of the college carried out preventive and explanatory work, trying to help the guy form skills of rational management of money. However, no positive effect was achieved.
In addition, for being in the hostel in a state of alcoholic intoxication, the guy was brought to administrative responsibility under Part 1 of Article 19.3 of the Administrative Code.
“According to paragraph 4 of article 25 of the Civil Code, if there are sufficient grounds, the court, at the request of parents, adoptive parents or guardian or guardianship authority, may restrict or deprive a minor aged 14 to 18 years of the right to independently dispose of his earnings, scholarship or other income. Therefore, in order to protect the rights and legitimate interests of the minor, as well as to prevent the commission of illegal acts by him, the prosecutor of the Narovlyansky district appealed to the court with a request to deprive the teenager of the right to independently dispose of the scholarship and other income, the regional prosecutor's office stressed.
The court granted the prosecutor's application and deprived the student of the right to independently dispose of his income until the age of majority. The court decision has not entered into legal force.
