The prosecutor’s inspection in the Znamensky district revealed violations of land legislation during the lease of agricultural land.
As established by the supervisory authority, in November 2024, two long-term lease agreements for agricultural land were concluded with one of the economic organizations. The basis was the decisions of general meetings of participants of shared ownership, while we were talking about land shares recognized as unclaimed.
However, as it turned out during the inspection, the procedure for holding these meetings was violated. In fact, only a representative of a local government body who spoke on behalf of the owners of unclaimed shares participated in them. The remaining owners of land shares did not attend the meetings, which contradicts the requirements of the current legislation.
Following the audit, the prosecutor’s office of the Znamensky district filed a lawsuit with the requirement to invalidate both the decisions of general meetings and the lease agreements concluded on their basis. In addition, the supervisory authority asked to exclude from the EGRN information on the registration of these transactions.
The court satisfied the requirements of the prosecutor’s office in full. At the moment, the court decision has not yet entered into force.
