Voronezh developer will pay for the illegal pond

The Voronezh developer could not replace monetary compensation for damage to the subsoil with reclamation.

The Central District Court of Voronezh refused to change the method of execution of the judgment. The developer, found guilty of illegal arrangement of the pond, tried to replace the payment of damage in the amount of 2 million 167 thousand rubles for natural reclamation of land, but the court sided with the environmental department.

As established during a joint inspection of the Voronezh Interdistrict Environmental Prosecutor's Office and the Ministry of Natural Resources of the Voronezh region, the company illegally built a pond on leased sites in close proximity to the Somovo microdistrict. Specialists of the Ministry calculated the damage caused to the subsoil, which exceeded 2.1 million rubles.

Earlier, the developer has already lost in the courts of the first and second instances, after which he filed an application to change the method of execution of the decision - from a monetary penalty to the restoration of the site. The Ministry of Natural Resources objected to this, pointing out that out of 7,395 square meters of disturbed land, the company is ready to reclaim only 2020 square meters (less than a third). In addition, a natural biocenosis has already formed in the pond - the settlement and spread of the animal world took place.

On October 5, the court refused to satisfy the requirements of OOO “Calendar of Holidays” and confirmed the developer’s obligation to compensate the damage caused to nature in full. The proceeds will go through “colored payments”: they have a strictly targeted purpose and can be spent exclusively on environmental measures.
