In the Penza region, the court restored the right of a resident of Spassk to dispose of maternity capital. Earlier, the woman returned the money to the state, since the housing purchased with their use was demolished, and she could not build a new family due to financial difficulties.
As reported in the Spassky district court, in 2013, the woman was issued a certificate for improving housing conditions in the amount of 466 617 rubles.
Subsequently, the residential premises acquired using matcapital were demolished. However, the family could not build new housing due to the deterioration of the financial situation. As a result, the woman returned the received funds to the budget.
Later, a resident of Spassk filed a lawsuit with the Department of the Social Fund of Russia in the Penza region, demanding to restore her right to dispose of maternity capital.
Having studied the evidence presented, the court came to the conclusion that the funds returned to the state were not actually used for the intended purpose - to improve housing conditions.
Since the woman returned the entire amount previously received, the court found no grounds to consider her as having lost the right to maternity capital.
As a result, the Spassky District Court satisfied the claims of a resident of the city and restored her right to dispose of maternity capital.
