The Bank of Russia announced that on September 15 initiated a trial in the General Court of the European Union. The regulator disputes the restrictions on the recognition of decisions of Russian courts and their enforcement in other countries.
The Central Bank said that they are trying to challenge Article 1(28) of Council Regulation No. 2026/1848 of 23 July 2026. It gives the courts of members of the bloc the right to prohibit Russian entities from applying for recognition and enforcement of decisions of Russian courts in any jurisdiction.
“The document is a direct attempt to interfere in the current legal proceedings in Belgium and prevent the Bank of Russia from implementing the decision of the Moscow Arbitration Court.” A40-345157/2025 in the case of Euroclear.
The Central Bank pointed out the disproportionateness of the restrictions established by the regulations. The measures affect the protection of the rights of the Bank of Russia outside the EU and include the application of financial sanctions for violation of injunctions. The CBR believes that the disputed provisions violate the principles of access to justice, legal certainty and immunity of central banks. Furthermore, the prohibition mechanism in all jurisdictions is characterized as extraterritorial and therefore unlawful.
