Novosibirsk residents told about the new rules of the marketplace from October 1

One of the major changes concerns the terms of cooperation. If the marketplace decides to change the responsibility of the parties, increase the commission or change the procedure for calculating it, change payments to owners of PVZ or the rules for receiving, storing and delivering goods, partners will have to be warned at least 45 days in advance. For the remaining unilateral changes, a period of at least 15 days is set.

The procedure for holding shares will also change. If the discount is provided at the expense of the seller, the site must warn him at least five working days in advance and obtain consent. At the same time, the seller will be able to set a minimum price below which the goods cannot be sold at his expense. It is also allowed to completely refuse to participate in such discounts - for this, the marketplace will not be able to block the cabinet or product card, remove it, reduce the rating or worsen the position in the search. If the discount is fully paid by the site itself, the consent of the seller is not required.

Separate requirements will appear for blocking cards and personal accounts. As a general rule, the marketplace must send a reasoned notice to the seller not later than three days before the restriction is applied and indicate which provisions of the contract or law have been violated. Immediate blocking is allowed in cases provided for by law, for example, if it is required by law, a court decision or a state body, or it is necessary to prevent illegal access to an account.

Once the reason for blocking has been removed, the restriction must be lifted within 48 hours of the date the site received the relevant information. If the reason is not eliminated within 90 days after the seller's notification, the operator will be able to remove the cabinet.

The procedure for appealing disputed decisions will also change. Before going to court, the seller, executor or owner of PVZ will need to send a complaint through the pre-trial review system. The site is obliged to provide such an opportunity and respond within 15 days. If the complaint is found to be justified, the measures applied must be canceled within 48 hours.

The new rules will also affect the owners of the points of issue of orders. The contract must specify the conditions for the acceptance, storage, delivery, delivery and return of goods, as well as the distribution of responsibility for their damage or accidental loss. In addition, the buyer in the PVZ will be able to inspect, unpack and check the goods, and if there is a fitting room - try it on.

The law also establishes new requirements for contracts between sites and sellers. They should indicate the procedure for calculating and determining the commission, the grounds and measures of responsibility, the rules for appealing decisions, the conditions for forming a rating and search ranking, as well as the procedure for changing the price and providing discounts. The current and previous editions of the market place contracts must be kept available for at least three years.

For sellers, there are several practical tasks before the new rules start. They are recommended to keep the current version of the offer and the history of notifications from the site, study the conditions for commissions, fines, discounts and locks, check the documents for goods, marking and information in the cards. It is also necessary to determine in advance whether the seller is ready to participate in the shares at his own expense, and if necessary, set the minimum price of the goods.

The changes will also affect self-employed with individual entrepreneurs. From October 1, the law provides for the ability to independently accept or reject orders, choose a time and place of work, simultaneously cooperate with several platforms and stop taking orders. At the same time, for certain areas, a restriction is introduced on the systematic and long-term work of one performer with one customer through the platform.

Separately, the law provides for the responsibility of the sites themselves. For example, violation of the procedure for granting a discount at the expense of the seller can entail a fine of up to 300 thousand rubles for a legal entity, pressure on the seller for refusing such a discount - up to 400 thousand rubles, and illegal blocking of the cabinet or violation of the procedure for considering complaints - up to 500 thousand rubles.

The new rules do not eliminate the requirements for the goods themselves. Certification, declarations, state registration, mandatory marking and other special rules continue to apply. Sites will have to more formally check the relevant information in the product cards.
