Minchanin found a passport and returned it to the owner, but became a defendant in the criminal case

A criminal case was sent to the court against a 43-year-old citizen who is accused of committing theft, the correspondent of the Minsk-Novosti agency was told in the Partizan district prosecutor's office.

The accused with a friend passed through the underground passage of the metro station "Tractory factory". Near the grocery store, a friend saw a passport on the floor, picked it up and went to the shopping facility to ask if the seller knew who owned the document. The woman responded negatively.

Then the defendant took the find, saying that he would try to find the owner himself. After examining the passport again, he found 185 BYNs under the cover, which he began to spend on personal needs.

After the attacker still found the owner of the document through social networks and arranged a meeting with him. Along the way, he removed the cover from his passport and, along with the medical statement, card, and 70 BYN buried under a tree. Minchanin hoped that the stranger would thank him, but he came to meet with police officers.

Initially, the defendant claimed that he had found the document without a cover. Later, law enforcement officers still established where the victim’s money went.

It turned out that the man that day visited the donor center and received payment for blood donation. On the way back, he dropped his passport, but soon caught up and returned to the underpass. The victim also entered the store. The seller said his document was found by two men. Then the citizen reported the incident to the line “102”. After a while, the accused himself came into contact with him.

A criminal case was opened against the Minsk citizen. By the way, at the time of the crime, he was under the influence of psychoactive substances.

- The accused since 2000 is registered with a doctor-narcologist, previously had problems with the law – the conviction was extinguished, said Timur Stuzhuk, Deputy Prosecutor of Partizan district. He was charged with secret theft of property (theft), that is, with committing a crime under Part 1 of Article 205 of the Criminal Code, the sanction of which is up to three years in prison. The citizen fully acknowledged the guilt, repented of what he had done, voluntarily compensated the damage caused to the victim. According to the expert, he needs compulsory treatment for drug addiction.

A preventive measure was applied against the accused in the form of a subscription not to leave and proper conduct.

According to the Deputy Prosecutor of the Partizansky district, often citizens simply do not know that, taking a find, commit theft and fall under criminal liability. For this, it is sufficient that the amount of damage caused is two or more basic values.

- Criminal liability for theft comes not only in the case of secret theft of property from its owner, said Stuzhuk. Theft can also be recognized as the conversion of property worth more than 2 basic values, which the previous owner somewhere forgot or dropped, if the finder did not comply with the procedure prescribed by law. The found property must be immediately returned to the owner or reported to the police or local executive and administrative body. This will prevent trouble in the future.
