The Arbitration Court of the Lipetsk region sided with the State Housing Inspectorate in a dispute with RIR Energy JSC: the company tried to cancel the decision on a fine for poor-quality heat supply to residents of houses on Michurin Street, but it failed to achieve its goal. This was reported in the joint press service of the judicial system of the region.
The story began with complaints from residents of houses No. 34 and No. 38A on Michurina Street. RIR Energy in these high-rise buildings acts as a single heat supply organization and performer of utilities for hot water supply and heating. People paid attention to the cold batteries, and Goszhilinspection went to the place with a check - experts measured the air temperature in the apartments and the parameters of the coolant at the entrance to the houses.
The results were disappointing: in a number of residential premises, the air did not reach regulatory values, and the coolant at the border of operational responsibility did not provide heating of the proper quality. Management company LLC "UK Elada" has repeatedly appealed to the resource officer with requests to improve the system, but the situation has not changed.
According to the results of the inspection, the deputy head of the State Housing Inspectorate issued a resolution: RIR Energo was prosecuted under Part 3 of Article 7.23 of the Administrative Code of the Russian Federation and imposed a fine of 80 thousand rubles. The company did not agree with this decision and appealed to the arbitration court, insisting that its actions do not constitute an offense.
However, the court dismissed the applicant’s arguments. As noted in the instance, being a performer of communal services, society is obliged to perform all the necessary complex of actions so that residents receive services of normative quality. The court found no grounds for recognizing the violation as insignificant or replacing the fine with a warning. After studying the materials of the case, listening to the positions of the parties and assessing the evidence, RIR Energo was denied the requirements.
The decision has not yet entered into legal force – it can be appealed within ten days in the Nineteenth Arbitration Court of Appeal.
