In Volgograd, the Prosecutor’s office defended the right of the child to alimony after the death of the mother
In order to protect the rights and legitimate interests of the child, the district prosecutor's office of Volgograd entered into civil proceedings to give an opinion, focusing the court on the need to refuse to satisfy the requirements
The prosecutor's office of Traktorozavodsk district of Volgograd defended the right of a minor to receive alimony. It was established that after the death of the mother of the child, his father, as a payer of alimony, initiated the issue of termination of enforcement proceedings in connection with the death of the claimant. In this regard, the court was presented with an application from the bailiff-executor to terminate the proceedings.
However, in fact, there was a possibility of transferring the right of claims to the successor - the guardian of the minor.
The court shared the position of the supervisory authority, refusing to satisfy the application for termination of enforcement proceedings.
