Re-registration of an SUV for a wife did not save a resident of Morshansk from confiscation

The Tambov regional court reviewed the sentence of a resident of Morshansk, convicted of re-driving transport while drunk.

The Morsha District Court found the man guilty of driving while intoxicated by a person already subject to administrative punishment for refusing to undergo a medical examination.

As established in court, in February of this year, the defendant sat behind the wheel of the Ssang Yong Kayron II drunk, although he had previously been brought to administrative responsibility, but did not draw conclusions for himself.

The court of first instance ordered him 180 hours of compulsory work and banned him from engaging in activities related to transport management for 2 years. Instead of the car itself, the state received 200 thousand rubles - the amount specified in the contract of sale.

The prosecutor appealed against the decision. It turned out that the car was bought in marriage and is jointly acquired property. After committing the crime, the convict re-registered her for his wife, and the money was not actually transferred.

The appellate instance agreed with the arguments of the prosecutor’s office and changed the sentence: the car was confiscated to the state.
