The court in Ryazan recovered interest for an illegal advance under the state contract for the FOC

The prosecutor's office of the Ryazan region has achieved in court the invalidation of an additional agreement to the state contract for the construction of a sports and recreation complex in Ryazan. This was reported in the press service of the supervisory authority.

During the supervisory measures, it was established that the capital construction department of the Ryazan region without legal grounds concluded an additional agreement with a commercial organization. The document provided for the payment of an advance payment by the customer in the amount of more than 129 million rubles, which violated the legislation on the contract system in the field of procurement.

The supervisory authority sent a statement of claim to the court demanding to recognize the agreement as invalid and recover interest from the contractor for the use of illegally obtained budget funds. The stated demands of the prosecutor’s office were fully satisfied.

After the judicial act enters into legal force, prosecutors will take control of the actual execution of the court decision and the return of funds.
