The rights of a young orphan were defended in Krasnodar thanks to the work of prosecutors. The Soviet District Court of Krasnodar considered an important civil case on the protection of the rights of an orphaned minor.
The story began with an inspection conducted by the prosecutor's office of the Karasun administrative district of Krasnodar. Employees of the department found out that the 12-year-old girl was left without parental care: her mother died, and now the child is in a new family - she was adopted.
However, the documents of the girl remained legal inaccuracy, which could affect her further rights and interests. In the birth certificate, information about the father was entered only from the words of the mother, and, as the inspection showed, these data were unreliable: the said man does not actually exist. Such a record could create legal risks - for example, when applying for benefits, inheritance rights or traveling abroad.
In order to eliminate the problem and reliably protect the interests of the child, the prosecutor's office sent a statement of claim to the court demanding to invalidate the paternity record. During the trial, the position of the supervisory authority was supported, and the court satisfied the requirements in full, the press service of the Prosecutor’s Office of the Krasnodar Territory reports.
