Nizhny Novgorod Commissioner for Human Rights Oksana Kislitsina said that she helped a rural teacher to recover from work after an unfair dismissal.
She was approached by a teacher with almost 40 years of experience in a rural school with the highest qualification category and many awards. She hasn't had a single disciplinary action in years. However, within a month, two penalties were applied to the woman, and then dismissed.
The Ombudsman’s office examined the circumstances and revealed gross violations both in the registration of labor relations and in the case of dismissal. The district administration offered to check and restore the applicant’s rights in the pre-trial order, but the check was not carried out, taking the side of the employer. Then the woman was helped to draw up a lawsuit, and staff members participated in the court, where they presented their position.
The employer proposed a settlement agreement: the teacher was restored to work, penalties were canceled, forced absenteeism was paid and moral damage was compensated. The court upheld the agreement. Now the teacher is again working in her native school, and the Ombudsman noted that the apparatus will continue to accompany her.
