The October district court of Lipetsk announced the verdict of a 40-year-old local resident found guilty under part 1 of article 264.1 of the criminal code of the Russian Federation – driving a car in a state of intoxication by a person subjected to administrative punishment. This was reported in the joint press service of the judicial system of the region.
As established by the court, in July 2026, the defendant, reliably aware of the administrative prohibition against him, sat behind the wheel in a state of alcoholic intoxication and began to move through the streets of the city. Earlier, in April 2026, a decree on bringing him to administrative responsibility for a similar offense came into force: then he was fined 45 thousand rubles and deprived of the right to manage for 1.5 years. Thus, at the time of the crime, the man was officially considered a person subject to administrative punishment and was deprived of his driving license.
When stopping the car by an authorized official, the defendant refused to comply with the legal requirement to undergo a medical examination for intoxication. By law, such refusal is equated with drunk driving - that is, in itself becomes the basis for criminal liability.
Taking into account the identity of the defendant and the presence of mitigating circumstances, the court imposed a penalty of mandatory work for a period of 300 hours with deprivation of the right to engage in activities related to driving vehicles for 2 years. In addition, the car brand VAZ 21074 confiscated in the state.
For drivers, this is a clear lesson: repeated driving under the influence of alcohol is no longer an administrative, but a criminal case, and the payment may include not only work and a ban on the profession, but also the loss of the car itself.
