The car of the driver, re-sitting behind the wheel in a state of intoxication, can be confiscated, even if it is registered on his spouse, but is their joint property, writes rg with reference to the Supreme Court (SC).
If the car can no longer be seized, the court can recover the amount corresponding to its value. In a new review, it is also necessary to establish the real value of the car sold.
Confiscation is also possible in respect of a car decorated for a cohabitant of the accused, if the court finds that in fact the car belonged to him.
"The ownership of the vehicle to the accused, who drove it in a state of intoxication, may be evidenced by a combination of such circumstances as the purchase of a car on their own or credit funds, the constant use of the car and the cost of its maintenance," the Supreme Court said.
The SC previously explained that the car belonging to the accused, used in repeated drunken driving, is subject to mandatory confiscation.
