The draft law proposes to ratify the Agreement between the Republic of Belarus and the Russian Federation on certain issues of execution of executive documents on which the collectors are state bodies and budgetary organizations of the Republic of Belarus, signed on April 2, 2026 in Moscow. The agreement is aimed at eliminating the problem associated with the transfer of funds recovered on the territory of the Russian Federation under executive documents in favor of state bodies and budgetary organizations of the Republic of Belarus.

In accordance with the amendments made in 2023 and 2025 to the Federal Law of the Russian Federation of October 2, 2007 No. 229-FZ “On Enforcement Proceedings”, state bodies and budgetary organizations of the Republic of Belarus are required to have an account with a Russian credit institution to file an application for initiation of enforcement proceedings on the territory of the Russian Federation (except for the recovery of alimony for children, compensation for harm caused to life or health, compensation for damage caused by crime).

The Budget Code of the Republic of Belarus does not provide for the possibility of opening accounts with Russian credit institutions by state bodies and budgetary organizations of the Republic of Belarus, in connection with which they cannot exercise their rights to present executive documents for execution.

The agreement will allow state bodies and budgetary organizations of the Republic of Belarus to use the accounts of the Ministry of Justice of the Republic of Belarus opened in a Russian credit institution as an account of the claimant for initiation of enforcement proceedings in the territory of the Russian Federation and subsequent transfer to the claimants or to the budget revenue.
