Daughters of Barnaul bakery worker killed by poisoning pay compensation

On the execution of the bailiffs of Barnaul was the proceedings for the recovery from LLC "Altai-Lavash" compensation for moral damage in the amount of 800 thousand rubles in favor of the daughter of an employee who died at the workplace from hydrogen sulfide poisoning. Immediately after the court decision, the bakery was asked to fulfill the requirements voluntarily.

However, the organization did not take action to repay the debt. In this regard, the bailiff applied enforcement measures. He issued a decree on the recovery of the company’s money from its bank accounts and on the prohibition of making changes to the Unified State Register of Legal Entities.

This ensured the full execution of the court decision – the entire amount of compensation was transferred to the daughter of the deceased employee, reported in the GUFSSP of Russia in the Altai Territory.

The incident at the Barnaul enterprise occurred several years ago. The investigation established that the director of Altai-Lavash LLC, engaged in the production of bread and flour products, rented a room for these purposes in the Oktyabrsky district of the regional capital. Inside, the entrepreneur dismantled the bathroom and installed a shower. During these works, the requirements for connecting to the sewer network and ventilation system were violated.

Because of this, the smell of hydrogen sulfide came to the production room from the sewer network through the shower ladder. However, the businessman did not pay attention to this and did not try to create safe conditions for workers.

As a result, on September 30, 2024, two employees working in the production shop received acute poisoning with hydrogen sulfide. The women were hospitalized in the toxicology department of the clinical hospital in serious condition. Subsequently, one of the workers died in a medical facility.

On the fact of poisoning, a criminal case was initiated under Part 2 of Art. 143 of the Criminal Code of the Russian Federation, that is, a violation of labor protection requirements committed by a person who is responsible for their observance, resulting in the death of a person by negligence. As a result, the directors of the enterprise were found guilty and sentenced to two years of suspended imprisonment with a probationary period of two years.

At the same time, the daughter of the deceased employee appealed to the court with a demand to recover from the enterprise three million rubles of compensation for moral damage. However, the first instance refused to satisfy the claim, indicating that the death of the woman is not related to production activities, and the employer provided the necessary security measures, including the proper condition of the water shutter in the bathroom.

Then the girl appealed, and there took a different position. The judicial panel on civil cases found that the employer did not ensure the safety of life and health of employees. According to the court, negligence committed during the organization of production activities caused an accident that led to the death of a woman.

Determining the amount of compensation, the court took into account the nature of the incident, the degree of guilt of the defendant, as well as the consequences for the plaintiff. In particular, it was noted that the 26-year-old daughter of the deceased lived with her mother one family, and the death of the latter caused significant moral suffering.

In this regard, the Altai Regional Court ordered Altai-Lavash LLC to pay 800 thousand rubles in compensation for moral damage to the daughter of an employee who died at the workplace.
