Kostromich could not sue the city hall for the drowned car

An attempt to save a couple of minutes and bypass the traffic jam in a puddle on Radiozavodskaya cost Kostromich 738 thousand rubles. When his car safely “sinked” during a summer shower, the man decided that the city authorities and bad showers were to blame, and went to court.

But the court sided with City Hall. The judges carefully examined the instructions for the car. It turned out that the plant allows this crossover to dive into water even 50 cm, if you turn on the air suspension and go slowly. Kostromich did not raise the air suspension in advance. Moreover, he drove ahead, not paying attention to the fact that other cars raised a real wave in front of him. The result is a hydraulic shock, flooded electronic circuit boards and a stalled engine.

The court decision clearly states that the driver acted presumptuously. He could calmly wait out the shower, go around or at least press the lift button. As the accident was solely due to the risk of the claimant's own driving, he was denied compensation.
