Ryazan residents explained how to recover compensation from a neighbor for tobacco smoke in the apartment

If smoke from a neighbor's cigarettes enters your apartment, you have the right to sue for civil action. This was told by lawyer Yaroslav Ostapenko in a conversation with Abzac. The claim must be filed at the place of residence of the offender.

In court, compensation for moral damage can be demanded. The plaintiff will need strong evidence: witness statements of neighbors, correspondence with a smoker or an official act of inspection of the premises.

The law defines areas of responsibility. There is no administrative fine for smoking inside your own apartment or on the balcony. But if tobacco smoke causes discomfort to others, this is a violation of their rights.

If a neighbor has arranged a place for smoking in public places - in the entrance, elevator or on the stairwell - you must file a report with the police, attaching a photo or video recording. For this violation threatens a fine of 500 to 1500 rubles under article 6.24 of the administrative code of the Russian Federation.

The lawyer recalled the decision of the Supreme Court on the suit of a man who complained about a neighbor downstairs, whose smoke fell into his apartment. The plaintiff asked for compensation of 250 thousand rubles. The court sided with him, but reduced the amount of payment to 5 thousand rubles.
