The court of St. Petersburg sent for review the dispute for 326 meters of Zhdanovka embankment

The Arbitration Court of the North-Western District sent for a new consideration a dispute between Mostotrest and the company City on Water about renting a section of the embankment of the Zhdanovka River. This follows from the documents published in the court file.

The dispute is about a part of the structure with a length of 326 meters and an area of 219.9 square meters, which is located on the Zhdanovka embankment between Zhdanovsky Bridge and the Red Kursant Bridge since 2025.

As follows from the documents, the company engaged in auxiliary activities related to water transport concluded a ten-year lease agreement with the St. Petersburg state budgetary institution Mostotrest. Temporary berthings of small vessels were established on the embankment during the navigation period from May 1 to November 1. The organization also pays monthly rent, and at the end of the work of the courts and the transition to the winter regime, the tenant transfers the facility to the institution. In January 2025, Mostotrest sent the tenant a notice of termination of the contract, citing arrears in rent for 2024. The company “City on the water” challenged this decision in court. In May 2026, the Thirteenth Arbitration Court of Appeal upheld this decision unchanged. This decision was due to the fact that the court considered that the organization paid the rent and there is no reason to cancel the contract.

But the cassation court on September 30, 2026 sent the case for a new hearing. The court considered that the authorities did not ensure the completeness of the study of all the circumstances and evidence in the case, in connection with which the conclusions of the courts of first and appellate instances cannot be recognized as lawful, substantiated, and therefore the decision is canceled.

Thus, the dispute on the termination of the lease and the release of the Zhdanovka embankment section will have to be considered again. The next meeting is scheduled to be held this year on December 15.
