The court removed the mortgage from the premises of the Tambov MFC on Maxim Gorky Street

Leninsky district court of Tambov has decided to release from pledge the premises of the multifunctional center, located at 18 Maxim Gorky Street. The total area of the facility is 2,617.9 square meters.

The trial was initiated by the regional Ministry of Property Relations and State Order. The Agency demanded to recognize the missing encumbrance in the form of a mortgage, which was established in February 2018 in favor of Sberbank. The pledge was collateral for loan obligations of Pervomayskkhimmash JSC.

As it turned out during the process, part of the debt to the financial institution was repaid by the Tambov Region Development Corporation, contributing 25.93 million rubles. The main part of the requirements at the end of 2022 was acquired by a private investor, but the rights under the mortgage agreement did not pass to him.

In court, the representative of Sberbank officially confirmed the absence of debt on these obligations. In addition, the enforcement proceedings were completed in December 2022, and the deadline for the presentation of the executive document had expired by that time.

The court sided with the plaintiff, having come to the conclusion that since the possibility of compulsory recovery of real estate was lost, the need to preserve the pledge disappeared. The burden must be lifted. The decision has now entered into legal force.
