Residents of the Tula region should take into account that the publication of someone else’s correspondence without the consent of its participants may entail criminal, administrative or civil liability. Honored lawyer of Russia Ivan Solovyov said in an interview with RT.
Depending on the circumstances, Article 137 of the Criminal Code of the Russian Federation on violation of privacy may be applied. For the dissemination of information constituting a personal or family secret, a fine of up to 200 thousand rubles or imprisonment for up to two years is provided. If the violation is committed with the use of official position, out of selfish motives or a group of persons, the term can reach four years.
Also in such cases, Article 138 of the Criminal Code of the Russian Federation on violation of the secrecy of correspondence, telephone conversations and other communications may be considered. It provides, in particular, a fine of up to 80 thousand rubles.
Liability may arise not only when posting messages in the public domain. According to the lawyer, sending someone else’s correspondence to work, family or general chat rooms can also be considered as the distribution of messages without the permission of the participants.
At the same time, the legal assessment depends on the content of the correspondence, the circumstances of its transfer and the availability of legal grounds for prosecution.
