Tulyakov warned when they can demolish the fence on the site

Owners of suburban areas in the Tula region may be obliged to dismantle the fence at their own expense, if it is installed with violations or infringes the rights of neighbors. This was told by RT member of the Public Chamber of Russia Yevgeny Masharov.

According to the expert, the requirements for height and type of fencing depend on the category of land and current local standards. As an example, Masharov cited the Moscow region, where, according to the rules he mentioned, the height of the fence should not exceed two meters.

At the same time, neighbors can agree in writing to install a fence of another type or to refuse it. Such a decision, as the specialist noted, must be agreed with the board of the garden partnership.

If the fence does not meet the established requirements, neighbors have the right to seek its dismantling. One of the possible reasons for the dispute may be a situation when the fence shades the neighboring area. If the court meets the relevant requirements, the owner will have to remove the fence at his own expense.

As Masharov explained, a separate fine for non-compliance with the height or type of fence is not directly provided for by the Administrative Code of the Russian Federation. However, other violations may result in administrative liability.

In particular, for the unauthorized occupation of someone else's land is provided for liability under article 7.1 of the administrative code of the Russian Federation. The fine is from 1 to 1.5% of the cadastral value of the site, but not less than 5 thousand rubles. If the cadastral value of the land is not determined, the amount of the fine can be from 5 to 10 thousand rubles.
