The Arbitration Court of Kalmykia satisfied the claims of the prosecutor's office on recognizing the object of capital construction as an unauthorized construction. The developer has to tear it down.

The prosecutor's office insisted that the cafe "Chale" built on Pyurbeyev Street in Elista does not meet town-planning and building standards and has signs of unauthorized construction. The building not only violates the rights and legitimate interests of an indefinite circle of people, but also creates obstacles to the functioning of the urban infrastructure. The building occupies a part of the land plot of common use, within the boundaries of which there is a sewage network owned by the Elistinsk city municipality. Due to the capital structure of the MUP "Vodokanal" is deprived of the opportunity to carry out the planned overhaul of the networks. Elimination of violations without demolition of unauthorized buildings is impossible.

The court agreed with the prosecutor's arguments. The execution of the court decision is under the supervision of the supervisory authority.
