In Krasnodar, dozens of families risk being left without land and houses in Starokorsunskaya

In Krasnodar on October 22, the Fourth Court of Cassation will hold a regular hearing on the high-profile case of land plots in the village of Starokorsunskaya.

The center of attention is the request of the city administration to cancel interim measures that have been in effect since the autumn of 2024. So far, the court has only accepted the motion for proceedings and invited the parties to submit objections.

The story began in 2019: then the Soviet District Court of Krasnodar ruled that David Topolyan received 14 land plots with a total area of over 36 hectares in Starokorsunskaya. Subsequently, these lands were repeatedly resold. Later, the initial court decision was canceled, and the prosecutor’s office demanded to return the plots to the municipality, recover 18.83 million rubles from Topolyan and dismantle some of the buildings erected by the new owners.

Over the years of litigation, the land actively participated in civil circulation: people issued rights, received construction permits, took loans, erected houses and commercial facilities. In a difficult situation turned out to be a variety of people – among them large families, families of SVO participants, veterans and entrepreneurs.

The position of the prosecutor’s office remains unchanged: the department is confident that liquid land was illegally removed from public ownership “in addition to the will of the public owner”, and the original scheme was purely commercial in nature. This point of view was supported by the courts: the first instance satisfied the requirements of the department, the appeal upheld the decision, and on September 30 the complaints of the owners were rejected.

However, for many participants, the proceedings are not over: they plan to appeal to the Supreme Court.
