But lawyers explain: according to the note to article 264 of the criminal code of the Russian Federation, “other power-driven vehicles” are those for the management of which by law requires a special right. And the Rules of the road (P.1.2) directly refer to "mopeds" two- and three-wheeled mechanisms with an electric motor with a capacity of 0.25 kW to 4 kW and a maximum speed up to 50 km / h. If your scooter "fits" into these parameters - you control the moped.

Lawyers and experts of the Public Chamber have long been sounding the alarm: the status of means of individual mobility in Russian law is a dark forest. Scooters are still not separated into a separate category of road users, which causes a lot of collisions. Some argue that SIM cannot be considered a crime at all. Others insist: if the electric scooter characteristics pulls on the moped, then the demand should be like a motorist. The courts appear to be in second place. And this is logical: a drunken scooter at a speed of 25-30 km / h is not a harmless pedestrian, but quite a projectile capable of killing.

And now the numbers. According to the Ministry of Transport of the Moscow region, only for the period from March 14 to August 22, 2026 in the region there were 113 accidents involving SIM. They killed 13 people and 115 were injured. Among the dead were two children.

The lion's share of accidents - 78 accidents - fell on personal scooters: 12 dead, 77 injured. For rental SIM - 35 accidents. For comparison: for the same period of 2025, there were 86 accidents and 5 deaths. Height at times! The peak came in June - 31 incidents.

The verdict of the Volokolamsk court is not a sensation. Similar decisions have already been made in the Khanty-Mansiysk Autonomous Okrug, Chelyabinsk and Kursk regions.
