Resident of Khohol district tried to challenge the sale of shares because of the depressed state
Khoholsky district court of the Voronezh region refused to satisfy the claim for invalidation of power of attorney and contract of sale of real estate, as well as the application of the consequences of the invalidity of the transaction

Khoholsky district court of the Voronezh region refused to satisfy the claim for invalidation of power of attorney and contract of sale of real estate, as well as the application of the consequences of the invalidity of the transaction.
As established by the court, the man issued a power of attorney to sell his half of the house and half of the land. On the basis of this power of attorney, the woman concluded a contract for the sale of these objects.
Addressing the court, the man referred to the fact that at the time of the power of attorney was in a depressed and oppressed state and was not able to understand the meaning of his actions and direct them.
However, the forensic psychiatric examination conducted in the case showed that the man did not suffer from any mental disorder during the period preceding the signing of the power of attorney or at the time of its signing. In addition, he lacked psychological characteristics that would deprive or limit his ability to understand the meaning of his actions or to direct them, as well as that could contribute to the formation of misconceptions about the nature of the transaction.
Having examined all the evidence presented, the court concluded that the circumstances cited by the plaintiff were not proved, and the claim was dismissed.
The court decision has not entered into legal force.
