Resident of the Orel region returned the selected certificate “Veteran of hostilities”

In the Soviet district court of Orel with a claim to the FKU “Military Commissariat of the Orel region” appealed to a local resident. As follows from the materials of the case, the man upon reaching military age was called up for military service. He arrived in a military unit in one region, and then was sent by the unit commander to another unit. According to him, he served in a separate intelligence battalion, which was located in the North Caucasus region. In the future, the man entered the educational institution at the correspondence department on a preferential basis as a participant in counter-terrorism operations. To confirm this fact, he appealed to the archives of the Ministry of Defense of the Russian Federation, received answers and references. The Military Commissariat of the Oryol region decided to issue a certificate “Veteran of military operations” to the Oryol resident. The man received the document and applied to the regional office of the Social Fund for the appointment of a monthly cash payment. After a while, the receipts stopped. The military enlistment office reported that a decision was made to refuse to issue a certificate and the need to return it.

In the courtroom, a resident of the region insisted that archival certificates fully confirm his participation in counter-terrorism operations in the North Caucasus. He asked to recognize the decision of the military enlistment office illegal, recognize the right to a certificate and oblige him to issue a document. The representative of the military enlistment office objected - he referred to the absence of extracts from the orders of the commanders of military units confirming participation in the counter-terrorist operation, or documents on wounds, contusions, injuries or award material.

The court examined the archival certificates of the Central Archive of the Ministry of Defense of the Russian Federation. It turned out that the Oryol resident served in military units, one of which was part of the United Group of Troops (Forces) to conduct counter-terrorist operations in the North Caucasus region. In the historical logbook of the military unit for the relevant years there is a record of the fulfillment of tasks as part of the group. In the military ID there is a mark on the preferential calculation of the length of service — 1 month of service for 1.5. The military commissar of the Zavodsky district of Orel issued a certificate of service as part of the United Group of Forces for non-competitive admission to an educational institution.

Servants of Themis noted that there are sufficient grounds for concluding that they participated in counter-terrorism operations. The decision of the military enlistment office to refuse to issue a certificate was recognized as illegal. The FKU "Military Commissariat of the Orel region" was obliged to issue this document. We add that the decision can still be appealed. The parties to the dispute have a month.
