Resident of Orsk demands from the hospital 600 thousand
The Soviet district court of Orsk has suspended proceedings in the case of compensation for moral damage and appointed additional forensic medical examination

The former patient of the regional clinical hospital requires 600 thousand rubles from the medical institution due to complications after surgery. Among her complaints is the lack of proper postoperative control. In particular, the woman did not have a control ultrasound before discharge. Already at home, she had complications that led to re-hospitalization, puncture and ten-day treatment in the hospital.
The medical institution is confident that the operation was carried out according to clinical recommendations. When discharged, complications were not revealed, and later problems with rehabilitation are called acceptable risks, about which the patient was warned and gave written consent to the operation.
Experts will determine whether there were defects in care, how much they affected the patient's health, and whether there is a link between hospital treatment and subsequent complications. It is on these conclusions that the decision of the court will depend.
There are two fundamentally different positions. The patient speaks of insufficient control after surgery - in particular, the absence of control ultrasound, which could identify the problem before discharge. The hospital insists that everything was done according to recommendations, and complications are an acceptable risk that the woman was warned about. The key is informed consent: if the patient has signed it, it does not negate the obligation of doctors to comply with postoperative surveillance standards. This is what the examination should establish. And a separate nuance: the cost of the study is borne by the medical institution - so the court considered it necessary to obtain an independent conclusion, and not rely only on the arguments of the parties.
Do you think that the signed informed consent should exempt the hospital from liability for complications, or is it the responsibility of doctors to monitor the post-surgery?
