Residents of Kherson explained when the neighboring fence may be obliged to demolish

Fences between neighboring suburban areas often cause conflicts. About the rules of installation of fences and possible consequences of their violation told RT member of the Public chamber of Russia Yevgeny Masharov.

According to the expert, the requirements for the height and location of fences depend on the category of land and current regional and municipal regulations. For individual housing construction sites, the relevant restrictions may be enshrined in land use and development regulations or land improvement documents.

Neighbors can also agree to install a different type of fencing or do without it. This requires the written consent of the owners of adjacent plots and coordination with the board of the partnership. At the same time, the general meeting of its members may allow the installation of blank fences from the streets and driveways.

If the fence is built in violation of the established requirements and, for example, shades a neighboring site, interested owners can apply to the court to dismantle it. If the court grants the claim, the cost of demolishing the fence will be imposed on the owner who installed it.

Residents of Kherson who plan to install or replace the fence should clarify the current local requirements in advance and coordinate disputes with neighbors to avoid possible litigation.
