The first court of cassation upheld the sentence in the criminal case of embezzlement of budget funds. The general director of the Voronezh organization was punished for fraud - 6 years in prison, but in combination with other crimes turned out to be 18 years. This was reported on October 15 in the Prosecutor’s office.
The left-bank district court of Voronezh has convicted the 55-year-old head of a commercial enterprise. He was found guilty under article “Fraud committed on a large scale” (part 4 of article 159 of the criminal code).
During the trial, it was established that the defendant organized the preparation of fictitious contracts, which were supposed to create the appearance of economic and financial ties between his company and a third party company. On the basis of these forged papers, he applied for a refund of value added tax from the budget.
To give the transactions the appearance of authenticity, the convict took care of the formation of forged invoices issued on behalf of an imaginary partner. Following his orders, inaccurate data on the purchase of goods and the performance of works were entered into the VAT tax statements for the final quarter of 2016.
Based on the submitted declaration, the fiscal authority transferred to the bank account of the organization compensation for value added tax in the amount of more than 8.7 million rubles.
The court imposed a sentence of 6 years imprisonment and a monetary penalty in the amount of 500 thousand rubles. Together with the punishment determined for other crimes, the final term was 18 years of imprisonment, to which a fine of 500 thousand rubles and a restriction of liberty for one year were added.
In addition, the court fully satisfied the requirements of the prosecutor’s office of the region for compensation for damage caused to the federal budget.
Not agreeing with the verdict and the decision of the appellate instance, the convicted person filed a cassation appeal. The prosecutor's office opposed her satisfaction.
The first court of cassation of general jurisdiction, taking into account the opinion of the prosecutor, left the verdict of the Left Bank district court of Voronezh unchanged, and the cassation appeal without satisfaction.
