Fatezh court terminated the contract for the purchase of laptops for educational institutions

In the Fatezh district of the Kursk region, at the request of the Prosecutor’s office, the transaction on the acquisition of computer equipment was canceled. The basis for the proceedings was the results of the inspection conducted by the supervisory authority.

During the inspection, it was revealed that the local educational institution signed a contract with a commercial company for the supply of laptops. However, serious deviations from the norms of the legislation were made during the registration of documents. In particular, the rules guaranteeing healthy competition, equal access of participants to tenders, as well as the principles of rational use of budget funds were ignored.

"To restore legality and protect the interests of the state, a lawsuit was sent to the court with the requirement to recognize the contract as void and apply the consequences of the invalidity of the transaction," the prosecutor's office of the Kursk region said.

Servants of Themis of the first instance sided with the plaintiff and decided to recover from the supplier the amount exceeding 1.7 million rubles. The defendant tried to challenge this decision by filing an appeal, but the higher instance did not find grounds for its cancellation, supporting the arguments of the prosecutor's office.

The ruling has already entered into legal force.

The question remains. Was the violation committed due to the illiteracy of the participants in the transaction or for selfish motives?
